UNCITRAL Working Group III: The Commission adopts the Working Group’s first outcome

During its July session, the UNCITRAL (Commission) adopted in principle the Code of Conduct for Arbitrators and . This is the first official outcome of the UNCITRAL Working Group III on Reform of ISDS since it commenced its work in 2017. While the Code of Conduct was considered by many a low-hanging fruit, the negotiations have proved complex (for analysis, see here). The resulting compromise leaves much to be desired and tends to codify the existing status quo rather than forging a new reform path. As it stands, it also leaves unanswered the questions of its implementation and enforcement (for an analysis of an earlier draft, see here).
